(ConservativeInsider.org) – Though 200,000 illegal aliens were meant to be deported soon, the Biden administration’s failure to file the proper paperwork has resulted in their deportations being cancelled.
The Transactional Records Access Clearinghouse (TRAC), a non-partisan data research group at Syracuse University, issued a report suggesting that the reason why 200,000 illegal immigrants had their deportation cases dropped was due to the Department of Homeland Security (DHS)’s failure to file notices when the illegal immigrants were due to appear at court.
The TRAC report pointed out that there is a “total lack of transparency” about the failures of DHS, including where and why the failures to file proper paperwork happened. The report went even further, pointing out there is no “solid information” about where these illegal immigrants are now, which will cause trouble in the future when DHS tries to restart the cases against them.
The Department of Homeland Security should have given these illegal aliens NTAs, or notices to appear, which are supposed to be issued when someone is apprehended while illegally crossing the border. A case cannot move forward without an NTA.
In 2020, fewer than 7,000 deportation cases against illegal immigrants were dropped due to the failure of NTAs not being filed. However, by 2023, that number had risen to nearly 70,000. By March of 2024, over 10,000 deportation cases have been dismissed due to a lack of NTAs. In the six years before Biden took office, less than 1% of scheduled deportation cases were dropped due to the NTAs not being filed. However, within Biden’s first three years as president, the rate shot up to 8.4%.
Some areas are better than others for filing NTAs, while some places are notorious for how frequently they do not file NTAs. For example, in both Houston and Miami, over 50% of deportation cases since 2021 have been dismissed due to a lack of an NTA.
The Department of Homeland Security did not respond to a request for comment on the issue.
