(ConservativeInsider.org) – In September 2021, the Department of Justice (DOJ) announced it was reviewing its policies about transgender inmates in correctional institutions. Former President Donald Trump authorized inmates to be housed based on their biological sex, not their gender identity. Recently, reports indicate President Joe Biden’s administration might reverse Trump’s rule, but a Republican Senator is hoping to stop that from happening.
On January 12, Senator Tom Cotton (R-AR) announced the Preventing Violence Against Female Inmates Act. The legislation seeks to protect biological women by preventing a biological male claiming to be transgender from being housed in the same prison as them. There’s a concern that a male might pretend to be a trans female in order to prey on women in the prison, much like the arguments against allowing men into women’s bathrooms.

In his statement, Cotton slammed Biden for his alleged “ill-conceived plan” to house inmates of the opposite sex in a prison together. He pointed out women are “at increased risk of sexual assault” by placing biological men in women’s prisons. The senator’s bill provides prisons with an option to keep trans inmates safe from abuse, as well. It states the prisons can set up specific housing units for those inmates, but they would not be housed with the opposite sex.
Although it’s unlikely Cotton’s proposal will go anywhere while Democrats are in charge, Republicans could enact this type of legislation if they regain control of the House and Senate in the midterm elections this November.
