Federal Judge Halts Biden Admin’s Trans Student Protection Policy

(ConservaiveInsider.org) – Despite the Biden administration’s attempts to expand nondiscrimination protections for LGBT students on a federal level by changing Title IX, on Monday, June 17, a federal judge blocked enforcement of those changes.

Title IX was enacted in 1972 to prohibit discrimination based on gender within any education program that receives federal funding. In April of this year, the Education Departments in Ohio, Kentucky, Indiana, West Virginia, Virginia, and Tennessee made changes to Title IX that would prohibit discrimination based on orientation and “gender identity,” the unscientific concept that one’s internal “gender identity” might not match their biology.

However, following a lawsuit from the Alliance Defending Freedom on behalf of the Christian Educators Association International and a teenage girl who was forced to play with a biological male on her sports team, U.S. District Judge Danny Reeves put an injunction on implementation of the rule. This follows another federal judge blocking the new Title IX rule in Idaho, Mississippi, Montana, and Louisiana earlier in June. There are also pending lawsuits against the rule in several other Republican-controlled states.

The ruling by judge Reeves, who was appointed to the bench by President George W. Bush, stated that there would be “immediate and irreparable harm” if the new Title IX rule went into effect. Reeves also stated in his ruling that the Department of Education failed to give a “reasoned explanation” for the rule change as to why biological males should be allowed in female spaces and that the DOE is seeking to “derail deeply rooted law.”

Russell Coleman, the Attorney General of Kentucky, said he was “grateful” for the ruling and that he would keep fighting against the Biden administration’s changes to “protect our women and girls.”

Biden’s new Title IX rule will go into effect on August 1 in every state where the rule has not yet been blocked. Republicans in both the House and Senate have filed disapproval resolutions hoping to stop the rule before it is enforced.
