(ConservativeInsider.org) – On Wednesday, December 27th, the Michigan Supreme Court dismissed an attempt to exclude former President Donald Trump from the state’s 2024 primary ballot. The court’s order prevents anyone from excluding Trump from the 2024 ballot under Section 3 of the 14th Amendment to the Constitution.
This section prohibits individuals who have “engaged in insurrection or rebellion” after taking an oath to support and defend the Constitution from holding office.
The court issued a brief order stating that it refused to hear a case arguing for Trump’s exclusion from the state’s ballot, as it is “not convinced that this court should review the questions raised.” The decision follows the rejection this month by the Michigan Court of Appeals of challenges to Trump’s candidacy on the state’s primary ballot.
In a unanimous 3-0 opinion referencing Michigan law, the appellate court stated, “Political parties and individual candidates determine who is placed on the primary ballot.”
Courts in Arizona and Minnesota have rejected similar attempts to remove Trump from the ballot. Last month, the Minnesota Supreme Court dismissed a petition by voters seeking to exclude Trump from the 2024 GOP primary and general election ballots, stating that Minnesota law does not prohibit major parties from including even ineligible candidates on the primary ballot.
On Wednesday, the Michigan Supreme Court issued an order that differs from the Colorado Supreme Court’s unprecedented decision last week, which prohibited Trump from running in the state’s primary next year based on constitutional grounds.
The Colorado ruling stated that, according to a majority of the court, President Trump is ineligible for the presidency under Section Three of the Fourteenth Amendment of the United States Constitution. Therefore, listing him as a candidate on the presidential primary ballot by the Colorado Secretary of State would be a wrongful act under the Election Code.
Trump commended the Michigan Supreme Court’s decision on his Truth Social account, stating that the court rightly rejected the desperate Democratic attempt to remove the leading candidate from the 2024 Presidential Election ballot in Michigan.
He also said, “This attempt to manipulate the election has failed nationwide, even in traditionally Democratic-leaning states. Colorado is the sole state that succumbed to the scheme.”
