Woman Files $100M Lawsuit Against DHS Over Daughter’s Death

(ConservativeInsider.org) – Grieving Tammy Nobles, devastated by the alleged rape and murder of her 20-year-old daughter, Kayla Hamilton, by a teenage MS-13 gang member from El Salvador, is filing a $100 million lawsuit against the US government.

She asserts that the Department of Homeland Security (DHS) and the Department of Health and Human Services (HHS) jeopardized lives by inadequately screening the suspect at the border, permitting entry despite an alleged gang affiliation. Nobles conveyed her sentiment, stating that the tragedy could have befallen anyone’s daughter.

The lawsuit emerges amidst a heated political debate over immigration policy, with Republicans using Kayla’s tragic death as ammunition against the Biden administration’s border approach. Nobles testified before the House Homeland Security Committee during an impeachment inquiry into DHS Secretary Alejandro Mayorkas, expressing her desire to spare any parent from experiencing the pain she is going through.

In an interview with NewsNation, Brian Claypool, the lawyer representing her, shared the same sentiment, stating that they were tired of DHS playing games with their lives and with Kayla’s life. Furthermore, he alleged that both agencies had failed Kayla and emphasized the potential recurrence of a similar tragedy due to alleged lax border procedures.

Claypool detailed specific points of contention, claiming authorities simply needed to follow their own protocol to expose a gang-related tattoo, potentially denying him entry in the first place. Additionally, he asserted that a quick phone call to El Salvador would have revealed the suspect’s prior arrest for MS-13 activity, further barring him from the US.

The lawsuit also targets HHS, accusing them of failing to verify the suspect’s sponsor and placing him in the same trailer where he encountered Kayla. While DHS and HHS declined to comment on the ongoing litigation, both expressed condolences to the Hamilton family.

Republicans, however, remain vocal, with the House Judiciary Committee’s May report condemning the Biden Administration’s open-borders policies as directly contributing to Kayla’s death. They claim DHS disregarded fundamental screening and vetting procedures when processing migrants, thereby putting the lives of Americans at risk.
